Terms of Service

Please read these Terms of Service carefully before using Zenai. They form a legal agreement between you and Zenai.

1. Acceptance of Terms

By creating an account or using Zenai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

Zenai provides AI-powered WhatsApp automation tools for businesses. The Service includes a bot management dashboard, intent scripts editor, product catalog sync, and analytics. Zenai is built on the official Meta WhatsApp Business API.

3. Account Registration

You must provide accurate information when creating your account. You are responsible for maintaining the security of your login credentials. You must notify us immediately of any unauthorised access at hello@zenai.co.ke.

4. Acceptable Use

You agree not to use Zenai to send spam, misleading content, or content that violates Meta's WhatsApp Business policies. You may not resell or sublicense the Service without written permission. Violations may result in immediate account termination.

5. Subscription & Payment

Zenai operates on a subscription model (KSh 3,000/month or KSh 2,500/month on quarterly billing). After the 7-day free trial, payment is required to continue using the Service. Payments are processed via M-Pesa or card. Subscriptions auto-renew until cancelled.

6. Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial months, except where required by law.

7. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. Downtime caused by third parties (Meta, Groq, etc.) is outside our control.

8. Intellectual Property

All software, branding, and content created by Zenai remains our property. Your business data, intent scripts, and conversation content remain yours. You grant Zenai a limited licence to process this data to provide the Service.

9. Limitation of Liability

Zenai is not liable for indirect, incidental, or consequential damages arising from use of the Service. Our maximum liability to you for any claim is limited to the amount you paid in the 3 months preceding the claim.

10. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify you of material changes via email at least 14 days in advance.

11. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
